This privacy notice is under the protection of "Advanced Technology Research S.A. de C.V.", hereinafter "ATR", being responsible for all the rights and obligations stated in this notice.

"ATR" is responsible under the terms of the Law for the collection, disclosure, storage, use, handling and transfer of personal data collected from any individual, hereinafter the "Holders".

We inform you that "Advanced Technology Research S.A. de C.V.", will process requests related to personal data and will promote the protection of personal data within "ATR". We inform you that ATR may collect your information in various ways, including:

  1. In person: When you request or acquire any of the services provided at the address mentioned above.

  2. Directly: When you provide us with your personal data to request our services, through our website or social networks or by phone.

  3. Indirectly: From any other source of commercially available information or that is permitted by Law

The information we collect from you may be combined to help us in the offering, provision and/or improvement of our services.

We inform you that "ATR" does not collect sensitive data as a result of the services

  3. When it comes to a legal entity, the corresponding identification and validity of the legal entity and its general legal documents will be requested.

CONFIDENTIALITY AND SECURITY MEASURES

The confidentiality and protection of your personal data is a priority for "ATR", which is why we have established and maintain technical, physical and administrative security measures. Among our security measures are password access to servers, multiple layers of access and one-way encryption of passwords, as well as monitoring and updating the corresponding laws.

PURPOSES TO WHICH THE PROCESSING OF PERSONAL DATA WILL BE SUBJECT

The processing of personal data of the holder, unless otherwise provided using the means described in this Privacy Notice, is intended to make known our technological services, and compliance with our terms and conditions in the provision of such services.

SECONDARY PURPOSES

Carry out marketing, advertising, promotion and telemarketing activities, of the goods, products and/or services that are offered, by any material and/or electronic means.

ARCO RIGHTS OF THE HOLDER

The Holder of personal data has the right to the following: (i) Access their personal data in possession of "ATR" and know the details of their processing, (ii) Rectify them in case they are outdated, inaccurate or incomplete, (iii) Cancel them when they consider that they are not being used in accordance with the applicable principles, duties and obligations, or (iv) Oppose their processing for specific purposes. These rights are known as "ARCO Rights".

EXERCISE OF ARCO RIGHTS

If the exercise of ARCO Rights is done in writing, the request must be submitted at our address addressed to the person in charge of personal data protection identified in this Notice, accompanied by the following information and documentation:

  1. Identification data of the holder of the personal data and/or their legal representative. In the event that the request is submitted through a legal representative, a copy of the document proving that capacity must be attached.

  2. The clear and precise description of the personal data with respect to which you seek to exercise ARCO Rights, as well as the right or rights you wish to exercise. The request must be signed at the end of the document and initialed at the bottom of each page.

  3. Address to hear and receive the response from "ATR", and, where appropriate, future communications and/or notifications, or your desire that our response and/or future notifications or responses be sent via email, indicating the respective email address.

  4. Copy of the current official identification of the holder of the personal data and, where appropriate, of their legal representative.

If the exercise of ARCO Rights is done by email, please send your communication to "ATR", at the email account contacto@atr.com.mx, accompanied by the following information and documentation:

  1. Identification data of the holder of the personal data and/or their legal representative. In the event that the request is submitted through a legal representative, a copy of the document proving that capacity must be attached. Documents can be scanned and attached to the email to verify their authenticity.

  2. The clear and precise description of the personal data regarding which ARCO Rights are sought to be exercised, as well as the right or rights to be exercised, which may be done in the text of the email or in an attached scanned document duly signed at the end and initialed at the bottom of each page.

  3. Expressly indicate the desire to receive the response from "ATR" to your request via email, indicating the corresponding email address.

  4. Current official identification of the holder of the personal data and, where appropriate, of their legal representative.

Once the request to exercise ARCO Rights is at the disposal of "ATR", regardless of the form in which it is received, the respective response will be issued within a period not exceeding 20 (twenty) business days from its receipt, which we will make known to you through the chosen means of contact.

If the request to exercise ARCO Rights is about the exercise of the right of access, "ATR" will make the information or personal data available to you through simple copies and/or electronic documents. "ATR", as responsible, may deny the exercise of ARCO Rights in the cases allowed by the Law and its Regulations, for which you must be informed of the reason for such denial. The denial may be partial, in which case "ATR" will carry out the access, rectification, cancellation or opposition in the relevant part.

This privacy notice may be modified by "ATR", the modifications will be promptly informed through email, phone or any other means of communication that "ATR" determines for this purpose.

DELIVERY, CANCELLATION AND RETURN POLICIES

Cancellation Policy

You may make the total or partial cancellation of a purchase made through the atr.com.mx page as long as the merchandise has not been sent to you, for this, you must send an email to contacto@atr.com.mx or by contacting us by phone at 01(33) 3040 5600. If at the time of receiving your notice (by any means mentioned above) the merchandise has already been sent, we ask you to reject the delivery at your address so that the courier service returns it to us. Upon receiving the merchandise back, we will refund you in the same original form of payment except for shipping costs.

If your form of payment was a bank deposit, we ask that at the time of requesting the cancellation you provide us with: Interbank CLABE, Bank and Name of the account holder; the refund will be made by electronic transfer for the amount of the order within the following five business days of obtaining your data. No refunds will be made if we do not have the aforementioned data.

In the case of partial cancellations, only the price of the merchandise will be refunded and not the shipping costs.

Shipping costs will only be refunded when the reason for the cancellation is attributable to ATR for not having stock and not being able to fill the order.

Return Policy

As an ATR customer, you may request the total or partial return of the merchandise purchased through our branches within 7 calendar days following the receipt of the merchandise, for which you may choose one of the following options:

In the event that the merchandise presents a factory defect, the physical exchange can be made if the branch you went to has the stock. If the branch does not have the stock, ATR will send the corresponding replacement directly from our headquarters. If you wish to return the merchandise for personal reasons and it is in perfect condition, the refund will be only for the price of the merchandise and not for the shipping costs, and depending on the form of payment there may be a penalty of a percentage of the value paid.

Shipping Policies

Our delivery service is only available in the Mexican Republic. ATR subcontracts the best companies specialized in courier services to carry out the delivery.

Check that all your data is correct and complete as this depends on the success of your delivery. The delivery time starts from the application of the charge, and is subject to availability from 7 to 15 days from the purchase. Delivery times vary according to the courier selected depending on the destination and occur at any time of the day. In order to offer you greater security in your delivery, all our merchandise travels insured.

Upon receiving your package, we recommend checking that it does not present any defect or alteration, if so, please do not receive it, write down the comments on the courier's ticket and report it immediately at Gaviota no. 1358, Colonia Morelos in Guadalajara, Jalisco, C.P. 44910, at the telephone 01 (33)3040 5600, at the email address contacto@atr.com.mx or visit our website www.atr.com.mx

At the time of delivery at your address, the person receiving the merchandise will be asked for an official identification (voter's credential, passport, migration form FM2 or FM3, or driver's license), so we ask you to have this document at hand.

ATR WEB TERMS AND CONDITIONS

REQUIREMENTS FOR THE USE OF ATR WEB:

If the user uses the services of Advanced Technology Research S.A. de C.V. on any of its sites, it means that they have read, understood and accepted the terms set forth above. If you do not agree with them, the user should not provide any personal information, nor use the services of the Advanced Technology Research S.A. de C.V. sites.

This ATR WEB Service is available to people 18 years of age or older. If you are under 18 years of age or are of legal age, but for any other reason or mandate of law are legally incapable, you must review this Contract with your parent or guardian to ensure that you and your parent or guardian understand and accept the terms and conditions of the same and therefore consent to your use of ATR WEB

You agree to provide accurate and complete information when registering and during the use of the ATR WEB Service and you agree to update your ATR WEB Registration Information to keep it accurate and complete.

You agree that Advanced Technology Research S.A. de C.V. may store and use the Registration Information you provide for use in maintaining and billing fees to your Account.

Any Registration Information will be subject to the provisions of the Advanced Technology Research S.A. de C.V. Privacy Policy at www.atr.com.mx/aviso-de-seguridad-y-privacidad

As a registered user of ATR WEB, do NOT disclose your Account information to anyone else. You are solely responsible for maintaining the confidentiality and security of your Account, and for all activities that occur in or through your Account, and you agree to immediately notify Advanced Technology Research S.A. de C.V. of any security breach in your Account. Do not disclose your Account information to any other person. Advanced Technology Research S.A. de C.V. will not be responsible for any loss arising from the unauthorized use of your Account.

Advanced Technology Research S.A. de C.V. may provide links to third-party Web sites as an additional service to you. You agree that Advanced Technology Research S.A. de C.V. is not responsible for examining or evaluating the content or accuracy and that Advanced Technology Research S.A. de C.V. does not warrant and will have no liability for any third-party materials or Web sites, or for any other materials, products, or services of third parties. You agree that you will not use any third-party materials in a manner that would infringe or violate the rights of any other party and that Advanced Technology Research S.A. de C.V. is in no way responsible for any such use by you.

THE USE OF THE SOFTWARE OR ANY PART OF THE ATR WEB SERVICE, EXCEPT FOR THE USE OF THE ATR WEB SERVICE AS AUTHORIZED UNDER THIS AGREEMENT, IS STRICTLY PROHIBITED AND INFRINGES THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND MAY BE SUBJECT TO ADMINISTRATIVE, CIVIL AND CRIMINAL SANCTIONS, INCLUDING MAY RESULT IN ECONOMIC COMPENSATION FOR DAMAGES, UNDER THE COPYRIGHT INFRINGEMENT.
